Aerial Firefighting Safety Conference
Attendee Terms and Conditions
By registering to attend the Aerial Firefighting Safety Conference, AFF, Attendee agrees to comply with the following Helicopter Association International (HAI) AFF Attendee Terms and Conditions (the “Terms and Conditions”).
1. Cancellation Policy
Registrants should email heliexpo@rotor.org by midnight on Friday, November 5 if they need to cancel their HAI AFF registration.
2. PHOTO/VIDEO RELEASE
By registering for HAI AFF, Attendee acknowledges that HAI or its agents may take photographs and video footage at HAI AFF and agree, by attending HAI AFF, that they may be so photographed or recorded. Attendee further agrees that HAI may use their name, likeness, and biographical information in connection with its use of such photographic images or video footage in educational, news, and promotional materials, whether in print, electronic, or other media, including but not limited to the HAI website or other websites, at no charge to HAI.
3. Health & Safety and Risk Acknowledgement
HAI is committed to the health and safety of our attendees, exhibitors, speakers, partners and staff. HAI will operate AFF in accordance with official federal, state government and local authority rules, following Center for Disease Control (CDC) guidelines and any additional venue or location-specific rules designed to mitigate the spread and contraction of COVID-19. By registering and attending AFF Attendee agrees to voluntarily assume all risks related to exposure and agree to not hold HAI, AFF or any of their affiliates including partners and sponsors, directors, officers, employees, agents, contractors, volunteers, or sponsored venues liable for illness. In addition to following all social distancing requirements and other protocols and requests of HAI and the Riverside Hotel with regard to COVID-19 mitigation while on the premises and at HAI AFF, Registrants agree that they will not attend any HAI or AFF event if they feel ill or have or suspect that they have been recently exposed to COVID-19.
4. Limitation of Liability
ATTENDEE AGREES TO ASSUME ALL RISK AND LIABILITY AND TO HOLD HARMLESS HAI, THE CITY OF BOISE, AND THE RIVERSIDE HOTEL, AND THEIR OFFICIALS, OFFICERS, DIRECTORS, MEMBERS, AFFILIATES, AGENTS, SERVANTS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, SUBCONTRACTORS, AND CONSULTANTS OF, FROM AND AGAINST, ANY AND ALL CLAIMS, DEMANDS, INJURY, DEFENSE COSTS, LIABILITIES, JUDGMENTS, LOSS, EXPENSES, OR DAMAGES OF ANY KIND OR NATURE ARISING OUT OF OR IN CONNECTION WITH:
(A) DAMAGE, FIRE DAMAGE, THEFT, DESTRUCTION, OR LOSS OF ANY PROPERTY BELONGING TO OR IN THE POSSESSION OR CONTROL OF ATTENDEE OR BELONGING TO HAI, THE CITY OF BOISE, OR THE RIVERSIDE HOTEL, AND/OR
(B) ANY INJURY (INCLUDING BODILY INJURY OR DEATH) TO ATTENDEE,
RELATING TO, ARISING OUT OF, CAUSED BY, OCCASIONED BY, OR IN CONNECTION WITH (1) ATTENDEE’S PARTICIPATION IN OR PRESENCE AT AFF, (2) ANY ACT OR OMISSION OF ATTENDEE, OR (3) ATTENDEE’S BREACH OF ANY OF THE TERMS OR PROVISIONS OF THESE TERMS AND CONDITIONS.
5. Enforcement of Rules
HAI has full power of interpretation and enforcement of these Terms and Conditions. Attendees who fail to comply with federal, state, and local laws or ordinances or who fail to observe these Terms and Conditions or who, at HAI’s sole discretion, conduct themselves in a manner inconsistent with the rights of other Attendees or Exhibitors, or who act in an unprofessional manner or in a manner unfavorable to the image of HAI may be removed from Aerial Firefighting Safety Conference without refund or other appeal and may be barred from future HAI events. This includes persons, things, printed matter, or anything that might be objectionable to HAI. Additionally, HAI and the Riverside Hotel retain the right to remove from the premises any and all disorderly Attendees and the right to eject any disorderly person or persons from the Riverside Hotel or any of its facilities, including the right to remove and eject persons who refuse to comply with health and safety requirements; in the event of the exercise of this authority, Attendee waives any and all claims for damages against HAI and the Riverside Hotel on account thereof.
6. Force Majeure
HAI Aerial Firefighting Safety Conference may be postponed or cancelled due to an uncontrollable event, including but not limited to fire, flood, earthquake, hurricane, storm, drought, and other extreme catastrophes or weather conditions, strike, lockout, failure of or threat of failure of facilities, equipment, mechanical or utilities, national emergency, global health crisis, epidemic, riots, terrorism, threats of terrorism, war, material or labor restrictions by any governmental authority, unavoidable casualty, industrial action, acts of God, severe curtailment of national transportation that represents a clear and adverse effect on the ability of at least forty percent of any documented pre-registered attendees to attend the event, governmental directive which would prohibit aircraft being flown into the City of Boise or onto the Riverside Hotel premises, unavailability of the Riverside Hotel premises, or any other circumstances or events beyond the control of HAI.
If HAI AFF is cancelled for any reason set forth in this Section 6, HAI may return a portion of the Attendee’s registration fee(s), but in no event shall the amount returned to Attendee exceed the total registration fee(s) amount already paid by Attendee to HAI.
Except as provided in this Section 6, HAI shall not, as a consequence of HAI AFF being postponed or cancelled, be responsible for any cost, damage, expenses, or loss of revenue that may be incurred by the Attendee.
Additionally, in the event that HAI AFF is not postponed or cancelled, but government regulations related to the COVID-19 pandemic would nevertheless prevent an attendee from participating in the Aerial Firefighting Safety Conference (such as a travel ban) or would result in substantial unanticipated costs to Attendee and the Attendee provides HAI with sufficient written documentation of such regulations and costs, HAI will allow Attendee to cancel for a full refund.
